This website and the Noosa Records store are operated by Surflong Pty Ltd (ABN 73 093 672 112), referred to in these terms as “Noosa Records”, “we”, “us” or “our”. By visiting this website or purchasing from us, you agree to these Terms of Service and our Privacy Policy.
1. Online store terms
You must use this website lawfully and provide accurate, current and complete information when placing an order. You must not misuse the website, interfere with its operation, transmit malicious code, attempt unauthorised access, or infringe another person’s rights.
2. Products and information
We aim to describe records, editions, formats, condition and availability accurately. Product colours and packaging may appear differently on different screens. Images may be illustrative. If a material listing error affects your order, we will contact you and offer an appropriate solution.
3. Orders and acceptance
Submitting an order is an offer to purchase. An order is accepted when we confirm it and receive payment. We may decline or cancel an order where stock is unavailable, information or pricing is incorrect, fraud is suspected, or we cannot fulfil the order. If we cancel an order after payment, we will refund the affected amount.
4. Prices and payment
Prices are shown in Australian dollars and include GST where applicable. Delivery charges are shown before checkout. Promotions may have additional conditions. You confirm that you are authorised to use the payment method supplied.
5. Availability and order-in records
“In stock at Noosa” items are ordinarily held locally. “Available to order” or order-in items are sourced after purchase and may take longer to arrive. Any timeframe shown is an estimate, not a guarantee. If a supplier cannot fulfil an order-in item, we will contact you and provide a refund or another option.
6. Delivery and collection
Delivery estimates are not guaranteed and may be affected by carriers or events outside our reasonable control. Please provide a secure and correct delivery address. Click-and-collect customers should wait for confirmation that their order is ready and bring suitable order identification.
7. Returns, refunds and consumer rights
Returns and refunds are handled under our Returns & Refunds Policy. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or another law that cannot lawfully be excluded.
8. Intellectual property
The website’s branding, design, text, photography and other original content are owned by or licensed to us. You may use the website for personal shopping and information only. You must not reproduce or commercially exploit our content without permission.
9. Third-party services and links
Our store may use Shopify, payment providers, delivery services and links to third-party websites. Those services may have their own terms and privacy practices. We are not responsible for third-party content or services outside our reasonable control.
10. Liability
To the extent permitted by law, we are not liable for indirect or consequential loss arising from use of this website. Where liability cannot be excluded, it is limited only to the extent permitted by law. This clause does not limit rights that cannot be limited under the Australian Consumer Law.
11. Privacy
We handle personal information in accordance with our Privacy Policy. Shopify and service providers may process information needed to operate the store, take payment, prevent fraud and deliver orders.
12. Changes and governing law
We may update these terms by publishing a revised version on this page. These terms are governed by the laws of Queensland, Australia, and applicable Commonwealth laws.
